BNT ‘SUMMER PRIZE POOL’ PROMOTION - TERMS & CONDITIONS

The Brake & Transmission NZ Ltd ‘Summer Prize Pool’ marketing promotion run by Brake & Transmission NZ Ltd (“BNT”) in New Zealand is subject to the terms and conditions contained in this document. By entering into the BNT ‘Summer Prize Pool’ promotion, each participant agrees to abide and be bound by these promotion terms.

ELIGIBILITY

  1. BNT promotions are only open to BNT authorised customer partners in New Zealand who are residents of New Zealand (“participants”). Promotional offers are not transferable or otherwise assignable to any other party except under mitigating circumstances at the discretion of BNT.
     
  2. A participant whose: (a) employer/company does not consent to the participant’s participation in the promotion; and (b) whose participation in the promotion violates his/her employer's/company's policies and procedures, is not eligible to participate in a promotion.
     
  3. Each participant agrees that as a condition to being awarded a prize, the winner may be required to sign a release and indemnity and/or declaration in the form required by BNT.
     
  4. The participants will be registered automatically for the promotion once they have earnt 1 ticket for spending $100 + GST (accumulated), less credits, on a participating brand qualifying products on their BNT Trade Account during the promotion period.
     
  5. Participants must comply with these terms throughout the promotional term (01 February to 31 March 2022) up until the time the prize is awarded and winning is contingent upon fulfilling all promotional requirements.
     
  6. Customer accounts must be kept up to date within terms by the account holder at all times during the course of the BNT ‘Summer Prize Pool’ promotion for the account holder to be eligible to win a prize.
     
  7. All accounts held by the Participant, including Capricorn accounts, are treated as separate entities, and therefore cannot be combined for the purposes of earning tickets. Tickets are not transferable or otherwise assignable to any other party except under mitigating circumstances at the discretion of BNT.

ENTRY REQUIREMENTS

  1. All products must be purchased from BNT. Any product purchase amounts will be calculated net of any returns and back orders will be excluded. BNT reserves the right to delay announcing prize winners up to fourteen (14) days following the end of a promotion to factor in returns made after the end of the promotional period.

PARTICIPATING BRANDS

  1. Tickets per Trade Account are earnt within the brands participating in that companies "Participating Brands".
     
  2. BNT participating brands including Australian Clutch Services, Bendix Euro+, Dayco, Brembo, Hengst, Fuchs Lubricants (NZ) Ltd, JAS Oceania NZ Ltd, Narva, NGK Spark Plugs, RAW 4x4, CPlus, SuperPro Suspension Parts, represented by but not limited to brand logos as per supporting promotional materials.

EARNING TICKETS

  1. During the promotion period, Account's earn 1 ticket for every $100 + GST spent (accumulated), less credits, per participating brand on their BNT Trade Account. Some brands only apply to selected lines. The Tickets are earnt within each brand of purchase. E.g., $100 in DAYCO = 1 ticket, $75 in BREMBO + $25 in NGK = 0 tickets, $65 in FUCHS + $135 in FUCHS = 2 tickets.
     
  2. Tickets will be recorded in an Account's ticket record for purchases by the Account, of qualifying products from a Participating Brand. Tickets may also be recorded in an Account's ticket record in relation to promotional offers.
     
  3. BNT and the participating companies will from time to time determine which goods or services are qualifying goods and services, the number of tickets that will be recorded in an Account's ticket record for such purchases and any terms and conditions that apply to the collection of tickets.
     
  4. BNT will from time to time forward a Ticket Summary to selected Accounts setting out the tickets recorded during the promotion period and the closing ticket balance.
     
  5. Disputes about the Ticket Summary must be notified to BNT within one week of receiving the Ticket Summary. The Ticket Summary will otherwise be taken to be correct and binding on the Account. BNT’s decision on any such dispute is final and binding.

PUBLICITY & PRIVACY

  1. Except where prohibited, participation in the promotion will be considered a participant's consent for BNT to use, without compensation, the participant's name, contact information and photograph, or other likeness, for advertising and publicity purposes, should the participant receive a reward. Such use may include advertising or publicity related to the naming of winners in this promotion or related to future similar contests. Participants also agree that BNT will own the right to any such image and photographs taken in relation to the promotion and the prizes awarded pursuant to the promotion. BNT will collect, use, or disclose personal information (if any provided) only for the purpose of administering the promotion, and will not disclose or provide to any third party any of the personal information provided on the entry form (if applicable) without the participant's consent.

PRIZES

  1. General: ANY TAX LIABILITY ARISING AS A RESULT OF ACCEPTING ANY PRIZE IS THE RESPONSIBILITY OF THE WINNER. Prize winners are solely responsible for: (a) all taxes, fees, and other assessments, as well as any additional expenses and incidental costs not included in the promotion/prizes as described; and (b) reporting any prizes to the appropriate taxing authority for tax purposes as required.
     
  2. Prizes are as specified in the promotional material and must be taken as offered and, if applicable, on the date/s specified. Prizes must be accepted as awarded and no substitution is permitted nor will cash equivalent be paid. Bapcor reserves the right to substitute the prize (or part of any prize) for one of equal or greater value in the event the prize is unavailable. Prizes are provided as-is and BNT makes no representations or warranties in respect of the prizes except for any liabilities that cannot be excluded by law. Prize values provided are based on the recommended retail price as provided by the prize supplier and are accurate at the time of printing the promotional material. BNT will not be held liable for any change in prize value after that date.
     
  3. Winners acknowledge that there may be intrinsic risks in some aspects of the prizes and that using such prizes may involve participating in dangerous/risky activities. By accepting the prizes, winners accept those risks. Winners may be required to sign a release and indemnity and/or declaration in the form required by BNT.

PRIZE AWARDING

  1. Participants selected to win a prize are not winners until confirmed as such. Participants will be notified that they are receiving a prize by telephone or email by a BNT representative. If they cannot be contacted within three (3) business days of being awarded a prize, fail the verification process, decline the prize, if applicable fail to return a signed release and declaration within ten (10) business days of being contacted, or fail to fulfil any such other requirement, the potential winner will be disqualified. BNT may select an alternate entrant from among all remaining eligible entries until a new winner is confirmed. BNT reserves the right to verify the validity of entries (if applicable) and identity of participant and to disqualify any participant who does not comply with the conditions of entry or who tampers with the entry process.
     
  2. Unless otherwise stated, BNT’s decision is final and the prizes will be delivered to prize winners within thirty (30) days of confirming the winner, including obtaining all necessary signed release or waiver forms in that regard. If no prize winners are established sixty (60) days after the end of the promotion period, the prizes will be cancelled.

 

General Terms & Conditions
 

  1. BNT reserves the right, exercisable in its discretion, to disqualify and ban any participant from a promotion, including where the participant is found or is believed to have been tampering with the process whether in relation to the entry process or otherwise, the operation of the promotion, or a promotion website or if the participant is found or is believed to have been attempting to contact, threaten, annoy, harass or abuse any other person who has participated in a promotion. Any attempt by any participant to deliberately undermine the legitimate operation of the promotion is a violation of law and should such an attempt be made or be successful, BNT reserves the right to seek damages or other penalties to the fullest extent permitted by law.
     
  2. These terms and conditions do not exclude or limit the applicable of any applicable law within New Zealand where to do so would contravene that statute or cause any part of these terms and conditions to be void.
     
  3. Except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law), BNT, its affiliates, directors, employees, agents, and contractors is not responsible for and excludes all liability (including negligence), for any loss, expense, damage, personal injury, illness, or death that may occur from; whether direct, indirect, special or consequential, arising in any way out of:

    (a) participating in this promotion or as a result of accepting or using any prize;
    (b) any technical difficulties or equipment malfunction (whether or not under BNT’s control);
    (c) any theft, destruction, unauthorised access, alteration of or third-party interference with entries and information submitted for a promotion that are being stored electronically;
    (d) any entry or prize claim that is late, lost, altered, damaged or misdirected due to any reason beyond the reasonable control of BNT;
    (e) any variation in prize value to that stated in the promotional material;
    (f) any tax liability incurred by a winner or participant;
    (g) any incorrect or inaccurate information or any other error, whether caused by other participants or by any equipment or programming associated with or utilised in the promotion or by any technical or human error which may occur in the processing of entries in the promotion;
    (h) injury or damage to participants' or any other person's computer related to or resulting from participating or downloading materials in a promotion.
     
  4. TO THE EXTENT PERMITTED BY LAW, IN NO EVENT WILL BNT, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS AND CONTRACTORS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES OR LOSS OF INCOME, REVENUE OR PROFITS, LOST OR DAMAGED DATA, OR OTHER COMMERCIAL OR ECONOMIC LOSS, ARISING FROM THIS PROMOTION, PARTICIPATING IN THIS PROMOTION OR AS A RESULT OF ACCEPTING OR USING ANY PRIZE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
     
  5. BNT reserves the right, in its sole discretion to, without advance notice, terminate or suspend the promotion, in whole or in part, or modify it in any way, including where the promotion is not capable of running as planned for any reason. BNT reserves its right to modify these Terms and Conditions at any time for any reason.
     
  6. The participation of any participant in a promotion in no way implies any form of employment, partnership, or joint venture with BNT.
     
  7. All promotions will be subject to New Zealand law, and the Participant irrevocably and unconditionally submits to the non-exclusive jurisdiction of its courts.
